CPC: Fines of €5.2 mn to Cyta, Forthnet

The Commission for the Protection of Competition imposed fines of €5.2 mn to the Cyprus Telecommunications Authority (Cyta) and Forthnet.

According to an announcement, the Commission by a decision dated 13/5/2015 imposed on CYTA and Forthnet a fine of €2.900.000 and €2.250.000 respectively for violating Articles 3(1)(a), 3(1)(b) and 3(1)(c) on the protection of competition laws of 2008 and 2014 and the corresponding Article 101(1) of the Treaty on the Functioning of the European Union, under the ex officio investigation.

The subject of the case was the ex officio investigation decided by the commission on 2/2/2012, regarding the cooperation between CYTA and Forthnet as a result of the agreement signed on 23/11/2011 for the disposal of the content of the subscription channels NovaCinema and NovaSports through the Cytavision platform as well as their action separately as a result of this cooperation in the sector of subscription channels / TV rights / video content on pay-TV.


As noted, the companies fixed prices indirectly and exchanged sensitive information with regard to their future commercial policy. This infringement constitutes an infringement by object, since the under reference conditions deprive the parties the autonomy of action in the market thus adjusting their behaviour in retail pay-TV market.


The commission, by decision dated 13/05/2015, enforces CYTA and Forthnet to immediately cease the infringements established and to refrain from repeating them in the future.
